These Terms and Conditions apply to services provided by HopToItGardening. By accepting a quote, booking a service or instructing HopToIt Gardening to commence work, you agree to these Terms and Conditions.
Terms and Conditions

1. Quotes
Quotes are based on the information, photographs and property details provided by the customer, or on an inspection of the property where required.
Unless otherwise stated, quotes are valid for 30 days from the date issued.
A quote may be revised if:

The information provided was incomplete or inaccurate

The condition or size of the property differs from what was described

Access to the work area is restricted

Additional labour, materials or equipment are required

The customer requests changes or additional work
Any significant changes to the quoted scope or price will be discussed with the customer before additional work proceeds.
2. Bookings and acceptance
A booking is confirmed once HopToIt Gardening has accepted the requested date and the customer has agreed to the quote or service price.
Requested dates are subject to availability and are not guaranteed until confirmed.
For larger jobs, turf installation, landscaping work or services requiring materials, a deposit may be required before materials are ordered or work is scheduled. Any deposit requirements will be stated in the quote.
3. Pricing and payment
Prices will be provided as a fixed quote, estimated price or agreed hourly rate, depending on the nature of the work.
Payment terms will be shown on the invoice or quote. Unless otherwise agreed, payment is due upon completion of the service or within the timeframe stated on the invoice.
The customer is responsible for paying all approved work, materials and additional services provided.
HopToIt Gardening may pause or decline further services where an invoice remains overdue.
4. Changes and additional work
The quoted price only covers the work specifically described in the accepted quote.
Requests for additional work may result in additional charges. Where possible, these costs will be discussed and approved before the additional work is completed.
Where unexpected conditions are discovered after work begins, HopToIt Gardening will contact the customer to discuss the available options.
5. Property access
The customer must provide safe and reasonable access to the property and work area at the agreed time.
The customer is responsible for:

Unlocking gates and access points

Securing pets
-
Moving vehicles, furniture, toys and personal belongings where required

Advising HopToIt Gardening of access restrictions
-
Identifying known hazards
-
Providing access to water or electricity where previously agreed
Where safe access is not available, the service may need to be postponed and a reasonable call-out or cancellation charge may apply.
6. Underground and concealed services
The customer must advise HopToIt Gardening of any known underground or concealed items, including:

Irrigation systems

Water pipes
-
Electrical cables
-
Gas services
-
Drainage systems
-
Septic systems
-
Internet or communications cables
-
Garden lighting
-
Invisible pet fencing
HopToIt Gardening will take reasonable care while performing the work but is not responsible for damage to concealed or incorrectly installed services that were not disclosed or reasonably visible.
This does not limit any rights that cannot legally be excluded.
7. Weather and unforeseen conditions
Outdoor services may be affected by rain, extreme heat, high winds, fire danger, water restrictions or unsafe ground conditions.
HopToIt Gardening may postpone or reschedule work where conditions make it unsafe, impractical or likely to result in poor-quality work.
Where possible, customers will be notified as soon as reasonably practicable and an alternative date will be arranged.
8. Cancellations and rescheduling
Customers should provide as much notice as possible when cancelling or rescheduling a confirmed service.
Where less than 24 hours’ notice is provided, HopToIt Gardening may charge a reasonable cancellation fee to cover costs already incurred, time reserved or materials ordered.
Deposits for specially ordered materials may be non-refundable where those costs cannot reasonably be recovered. Any applicable conditions will be explained before the deposit is paid.
9. Lawn and garden condition
Results may vary depending on factors outside HopToIt Gardening’s control, including:

Existing lawn or soil condition

Weather
-
Watering
-
Pest or disease activity
-
Drainage
-
Shade
-
Pet activity
-
Customer maintenance after the service
-
Pre-existing damage or plant health
HopToIt Gardening does not guarantee that weeds, pests, lawn damage or plant-health issues will be permanently resolved after one service.
Ongoing treatment or maintenance may be recommended.
10. Turf, Treatments and Aftercare
The success of turf installation, lawn treatments and other garden services may depend on ongoing care and conditions outside HopToIt Gardening’s control, including watering, weather, soil quality, drainage, pests, disease, pets and customer maintenance.
Customers are responsible for following any watering, safety, access or aftercare instructions provided.
Before lawn treatments or chemicals are applied, customers must advise HopToIt Gardening of any relevant sensitivities, pets, children, vegetable gardens, ponds or other concerns.
HopToIt Gardening cannot guarantee permanent results from a single treatment or accept responsibility for deterioration caused by unsuitable conditions or failure to follow the recommended care instructions.
11. Green Waste and Disposal
Green waste removal is only included where stated in the quote or service description.
Additional charges may apply for large volumes of waste, soil, concrete, building materials, heavy items or specialist disposal fees.
Where removal is not included, waste may be placed in the customer’s green-waste bin or left neatly at the property as agreed.
12. Property Conditions and Damage
HopToIt Gardening will take reasonable care while working at the property.
Customers must advise of any fragile items, damaged structures, loose paving, irrigation fittings, garden ornaments, underground services or other hazards requiring special care.
HopToIt Gardening is not responsible for pre-existing damage, normal deterioration or damage caused by hazards or concealed services that were not disclosed or reasonably visible.
Nothing in these Terms excludes liability where it would be unlawful to do so.
13. Photographs and Privacy
HopToIt Gardening may take photographs before, during or after work for quoting, record-keeping and quality-control purposes.
Photographs will not be used publicly for marketing where the customer or property can reasonably be identified without permission.
Personal information will be used to respond to enquiries, prepare quotes, schedule and provide services, process payments and maintain business records. Information will be handled in accordance with the HopToIt Gardening Privacy Policy.
14. Consumer Rights and Concerns
HopToIt Gardening’s services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms and Conditions limits any consumer right, guarantee or remedy that cannot legally be excluded.
Customers should contact HopToIt Gardening as soon as possible if they have concerns about completed work. HopToIt Gardening will review the concern and, where appropriate, arrange an inspection or reasonable opportunity to address the issue.
15. Website Information and Governing Law
Information on this website is general in nature and may change without notice.
Photographs are illustrative, and results may vary depending on the property and site conditions. Any prices displayed are indicative unless expressly stated otherwise, and a personalised quote may be required.
These Terms and Conditions are governed by the laws of South Australia and applicable Commonwealth laws.
